PLEASE READ THESE TERMS OF SERVICE ("TERMS") CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS.

1.1. GOVERNING AGREEMENT

The terms of this agreement ("Terms of Service" or "Terms") govern the relationship between you and SITEBIN ("site" or "Us" or "We" or "Our") regarding the use of SITEBIN’s site and related services, including applications for social media and mobile devices.

1.2. PRIVACY POLICY

Use of SITEBIN is also governed by SITEBIN’s Privacy Policy, which is contained herein by reference. Your privacy is important to us. Our Privacy Policy is designed to provide important disclosures about what type of information we collect and how we use your content and information. We strongly encourage you to read through the SITEBIN Privacy Policy to understand how your information is collected and used.

By creating an account through SITEBIN, you accept and agree to be bound by these Terms and consent to the collection, storage, and use of your information as outlined in the SITEBIN Privacy Policy.

1.3. UPDATES TO THE TERMS OF SERVICE

At any time, these Terms of Service may be updated. If and when these Terms of Service are updated, the "last updated" date in the Terms of Service will also be updated to indicate changes made. By the continued use of this Website after a new or updated Terms of Service has been posted, you consent to updates and alterations in accordance with the new policy.

1.4. GRANTING LIMITED LICENSE TO USE SERVICES

By participating in the service provided by SITEBIN, and hence, agreeing with these terms, you understand that SITEBIN grants you a non-exclusive, non-transferable, revocable limited license to access the SITEBIN service using a web browser or mobile device solely for your own non-commercial entertainment purposes and nothing else.

You understand that while you may "earn" or "win" (1) virtual currency, including but not limited to BrokerBucks and (2) virtual awards or achievements, these do not transfer to actual "ownership" of virtual items and the amounts of any virtual currency or the like do not transfer to any real world tangible currency or equivalent. Rather, you are able obtaining a limited license to use the service provided by SITEBIN. Any virtual currency balance maintained in your account does not a constitute real-world currency balance or reflect any stored value. Instead, it simply constitutes a measurement of the extent of your license.

1.5. ACCESSING THE SERVICE

By accessing or using the service provided by SITEBIN, you are accepting and agreeing to these Terms of Service and the Privacy Policy. In addition, to access the service, you may be required to register an account on SITEBIN to connect with the service. If you are between the ages of 13-17, your agreement and use of this service indicates that your legal guardian has reviewed and agreed to these Terms as well.

To access this service, you must provide all of the equipment and software needed to connect to the service. You are also responsible for any and all fees/costs incurred when accessing this service, including internet fees.

1.6. USE OF SERVICE

The following restrictions apply to the use of this service:

  1. You will not create an account or access SITEBIN if you are under the age of 13;
  2. You will monitor your account to ensure minors under the age of 13 are not accessing your account. By agreement to these Terms, you accept full responsibility for unauthorized use of SITEBIN and any use of payment instruments by minors accessing your account;
  3. You will not have more than one account at any given time. You will not create an account with a false identity or information or on the behalf of someone else;
  4. You will not use SITEBIN if you have previously been banned from using the service;
  5. You will not use SITEBIN if you are located in a country embargoed by the United States or if you are on the U.S. Treasury Department’s list of Specially Designated Nationals;
  6. You will use your account for non-commercial purposes only;
  7. You will not use your account to advertise or solicit in any manner, including junk or spam email;
  8. You will not use your account to engage in any illegal conduct;
  9. You will not sublicense, rent, lease, sell, trade, gift, or transfer your account or virtual items licensed in your account to anyone without the written consent of SITEBIN; and
  10. You will not access or use accounts or virtual items that have been sublicensed, rented, leased, sold, traded, gifted, or transferred from the original account owner without SITEBIN’s approval.

1.7. ACCOUNT INFORMATION

When creating or updating your SITEBIN account, you may be required to provide personally identifiable information which may include your username, email address, etc. This information will follow the procedures set forth in SITEBIN’s Privacy Policy. You agree that any information you provide to SITEBIN will be accurate and complete, and if any changes in information occur, you will update SITEBIN promptly.

1.8. USERNAME AND PASSWORD

During the original account opening process, you may be required to create a password and/or username. The following rules shall govern your username and password creation and maintenance:

  1. You will not share your account or login information with anyone, allow anyone else to access your account, or do anything to jeopardize your account’s security;
  2. If you become aware or suspect a breach in security on your account, you must immediately report this to SITEBIN;
  3. You are the only party responsible for the confidentiality of your login information including any and all uses of you this information, whether authorized by your or not;
  4. Any and all occurrences inside of your account are your responsibility.

SITEBIN can remove or reclaim any username at any time and for any reason.

1.9. LICENSE LIMITATIONS AND RESTRICTIONS

Using SITEBIN in violation of the below listed limitations and restrictions is prohibited and can result immediate termination of your limited license as described in Section 1.4. Additionally, you may be subject to violations of law. ATTMEPTS BY YOU TO INTERFERE WITH OR MANIPULATE SITEBIN’S SERVICES ARE IN VIOLATION OF SITEBIN POLICIES AND BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS.

Under no circumstances will you engage in the following:

  1. Act in any that SITEBIN deems to be in conflict with the intent of the service as laid out in these Terms;
  2. Submit false abuse reports or use profanity and abusive language in communication with our support staff; or
  3. Use SITEBIN in connection with any violations of laws or regulations.

CHEATING AND HACKING – Under no circumstances will you engage in the following:

  1. Cheating in any capacity is in violation of SITEBIN’s Terms. This includes using cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third party software designed interfere with SITEBIN’s service;
  2. Use SITEBIN to assist in the creation of any of the violations listed in number 4;
  3. Change or attempt to change any files that are part of SITEBIN without the expressed written consent of SITEBIN;
  4. Lead or assist in leading a disruption overburdening of any system, server, or computer associated with SITEBIN;
  5. Lead or assist in leading an attack upon SITEBIN, including but limited to virus spreading or disruption of service;
  6. Attempts to access accounts that you are not authorized to access.

OFFENSIVE AND/OR INFRINGING CONTENT – Under no circumstances will you engage in the following:

  1. Posting of information that is abusive, threatening, or in any other way offensive;
  2. Posting or sending harassing messages.

UNAUTHORIZED USE – Under no circumstances will you engage in the following:

  1. Interference with SITEBIN’s intended purpose;
  2. Use of unauthorized third party software in any manner that would violate the SITEBIN Terms of Services;
  3. Intercept or try to examine any proprietary communications between SITEBIN staff or users;
  4. Automate or attempt to automate the use of SITEBIN;
  5. Bypass or attempt to bypass measures we use to restrict access to the services and uses of SITEBIN;
  6. Unauthorized connection to SITEBIN;
  7. Attempt to obtain the source code for SITEBIN;
  8. Copy and/or distribute and content belonging to SITEBIN;

PERSONAL INFORMATION – Under no circumstances will you engage in the following:

  1. Solicit or attempt to solicit personal information from users of SITEBIN;
  2. Collect and/or post user or staff information that is not permitted under these Terms of Service;
  3. Upload or attempt to upload any information collection mechanisms without explicit consent from SITEBIN.

1.10. SUSPENSION AND TERMINATION OF ACCOUNT

At anytime, SITEBIN reserves the right to suspend and/or terminate accounts that are suspected to or have been found to violate the Terms laid out in this notice. If you or your account is suspected to be in violation of any of these terms, suspension and/or termination of you account can be affected without your prior consent.

In addition, SITEBIN reserves the right to suspend and/or terminate any part of the SITEBIN service at any time we desire. This includes, and is not limited to, SITEBIN online and SITEBIN mobile.

1.11. OWNERSHIP

By opening an account, you agree that all games, services, accounts, virtual currency, virtual items, user content, and any other information or content is completely and solely owned by SITEBIN.

1.12. USE OF TEMPORARY LICENSE

Through SITEBIN, you are able to obtain a temporary license to use virtual items, including BrokerBucks.

You can obtain temporary licenses for virtual currency by opening a SITEBIN account and playing the game which re-affirms your agreement to these Terms. Additionally, upon opening an account, we may send you a confirmation email containing details of the new account and uses of the temporary license.

Furthermore, you realize that your temporary license will be revoked and you will not receive any "real world" money or other compensation for BrokerBucks or other virtual items when your account is closed, whether voluntary or not.

1.13. DISCLAIMER OF WAIVERS AND INDEMNIFICATION

You agree that the use of SITEBIN and any services provided are at your own risk and herby acknowledge and agree that to the fullest extent permitted by any applicable law, the disclaimers of liability contained here apply to any and all damages or perceived damages resulting from the use, attempted use, or inability of use of SITEBIN and any of our services.

Additionally, you agree that SITEBIN will not be liable for any damages or perceived damages resulting from the conduct of a third party associated with SITEBIN.

You agree to indemnify, save, and hold SITEBIN, its affiliated companies, contractors, employees, agents and its third-party suppliers, licensors, and partners harmless from any claims, losses, damages, liabilities, including legal fees and expenses, arising out of your use or misuse of the Service, any violation by you of these Terms of Service, or any breach of the representations, warranties, and covenants made by you herein. SITEBIN reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify SITEBIN, and you agree to cooperate with SITEBIN’s defense of these claims. SITEBIN will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.

You agree that the provisions in this paragraph will survive any termination of your account(s) or of the Service.

1.14. DISPUTE RESOLUTION

In disputes between you and SITEBIN, our goal is to determine the nature of the dispute and come to an agreement that can be effective for both parties. As such, we recommend that you contact our Customer Support to best resolve any disputes that may arise.
